SURINDER GUPTA, J.(Oral) The petitioner has filed this petition under Section 482 Code of Criminal Procedure (for short, 'Cr.P.C.') seeking quashing of complaint No.5415/2.12.15 dated 02.12.2015 titled as " M/s Gulf Asphalt Vs. Sudhir Sharma and another" (Annexure P-2) along with summoning order dated 02.12.2015 (Annexure P-3) passed by learned Judicial Magistrate 1st Class, Gurgaon and subsequent proceedings arising therefrom. Learned counsel appearing for respondent No.1 fairly conceded that cheque was issued by Sudhir Sharma, which was dishonoured. However, in the complaint petitioner was made a party as the complainant was of the view that Sudhir Sharma had committed fraud with them in connivance with petitioner. She submits that she has instructions from the complainant to submit that it has no objection if the petition is allowed.
