State of Punjab .............Respondent CORAM: HON'BLE MR.JUSTICE JASWANT SINGH Present:- Mr.AS Kakkar,Advocate for the petitioners Mr.Kirat Singh Sidhu,DAG Punjab with HC Charanjit Singh Jaswant Singh,J.(Oral) Prayer is for grant of anticipatory bail on behalf of accused Ranjit Singh, Gurbinder Singh and Bittu Singh @ Lakhveer Singh in case FIR No. 40 dated 29.7.2013 under Sections 452, 332,353, 186,427, 148,149 IPC and Section 3 of Prevention of Damage to Public Property Act,1984, PS Bariwala, District Muktsar. It is contended that it is on record that the Investigating Officer has found, after visiting the spot, that there was no torn record or damaged furniture. The allegations qua causing injuries to public servants are not substantiated by any medical evidence.
Thus,it is contended that there is no basis to differentiate the cases of the present three accused from rest of the named 6 accused who have been granted benefit of pre-arrest bail. It is further submitted that for almost 21⁄2 years no challan has been presented till today. The said factual position is not disputed by the learned State counsel.
