There was recovery of 5 grams of heroin which is small quantity. Petitioner was enlarged on bail and for his solitary nonappearance on 13.10.2015 his bail bonds were cancelled and NBWs issued for 1.2.2016. The reason for absence is rest advised due to backache.

Vide order dated 15.3.2016 while issuing notice of motion, petitioner, on surrendering before the trial court within 10 days, was directed to be released on interim bail.

CRM-M 8985/2016 At the time of hearing,learned counsel submits that pursuant to the said order petitioner has surrendered before the trial court on 22.3.2016 and was released on interim bail. The said factual position is not disputed by the learned State counsel.

In view of the above, interim bail granted by the trial court pursuant to the order dated 15.3.2016 passed by this court, is made absolute.
