ALKA SARIN, J. (ORAL) 1.

This is a petition under Section 438 of the Code of Criminal Procedure, 1973 for grant of anticipatory bail to the petitioner in FIR No.15 dated 22.01.2022 under Sections 366, 452, 427, 365, 506, 148, 149 of the Indian Penal Code, 1860 registered at Police Station Division No.5, Jalandhar.

On 19.05.2023 the following order was passed : "Petitioner - Rohit @ Sonu @ Actor has filed petition under Section 438 Cr.P.C. for grant of anticipatory bail in FIR No.15 dated 22.01.2022 under Sections 366, 452, 427, 365, 506, 148 and 149 of IPC registered at Police Station Division No.5, Jalandhar. Copy of FIR is Annexure P-1. It is argued that all the allegations leveled

-2against him are false. The main accused, namely, Ritik @ Ranjam was granted interim relief vide order dated 02.06.2022 and finally the said anticipatory bail was allowed by this Court vide order dated 29.03.2023, which is Annexure P-2. It is argued that in the statement of victim recorded under Section 164 Cr.P.C., she admitted her affair with main accused Ritik @ Ranjam and the marriage was performed later on. The petitioner is ready to join the investigation.

Notice of motion.

On the asking of this Court, Mr. Kunwarbir Singh, Assistant A.G. Punjab, accepts notice on behalf of the State.

Considering the aforesaid facts, the arrest of the petitioner is stayed till the next date, subject to the joining of investigation.

Adjourned to 11.08.2023.

Status report be filed by respondent-State by the adjourned date."

Learned counsel for the petitioner would contend that pursuant to the said order, the petitioner has joined investigation and has fully cooperated.

Learned counsel for the State, on instructions from ASI Prem Pal, has stated that the petitioner has since joined investigation on 16.06.2023 and has fully cooperated and that he is no longer required for

-3further custodial interrogation as of now.

In view of the above, the order dated 19.05.2023 is made absolute. The petitioner shall, however, join investigation as and when called. The petitioner shall also abide by all the terms and conditions as specified under Section 438(2) of the Code of Criminal Procedure, 1973. 6.

Disposed off accordingly. Pending applications, if any, also stand disposed off.
