**** HARSIMRAN SINGH SETHI , J. (ORAL) In the present writ petition, the grievance of the petitioner is that a person junior to her, namely, Smt. Vijay Laxmi, was getting a higher pay than the petitioner and hence petitioner is entitled for the step up of her pay equivalent to Smt. Vijay Laxmi. Counsel for the petitioner states that petitioner was appointed on 14.09.1989, whereas Smt. Vijay Laxmi was appointed on 15.09.1989 and as Smt. Vijay Laxmi belongs to the reserve category of Scheduled Caste, she was promoted as a Principal on 30.06.2001 whereas the petitioner was promoted on the said post on 17.02.2010 and therefore, once the petitioner had caught Smt. Vijay Laxmi in the cadre of Principal, she was entitled for the stepping up of her pay keeping in view the instructions, which have been issued by the Government of Punjab dated 14.03.2017 (Annexure P-1).

CWP-14226-2019 -2Counsel for the petitioner further states that for the relief, which has been sought in the present writ petition, petitioner has also served the respondents with a legal notice on 29.03.2019 (Annexure P-4), which is still pending consideration with the respondents and the petitioner will be satisfied, at this stage, in case a time bound direction is issued to the respondents to decide the said legal notice by passing an appropriate speaking order.

Without expressing any opinion on the merits of the case and entitlement of the petitioner in respect of the claim made in the writ petition/legal notice, the respondents are directed to decide the legal notice dated 29.03.2019 (P-4) within a period of three months from the date of receipt of a certified copy of this order. In case it is found that the petitioner is entitled for any relief, the same shall also be released to her within a period of next three months.
