In the present petition, the petitioner is praying for issuance of a writ in the nature of mandamus directing the respondents to grant pensionary benefits to the petitioner taking into consideration the last drawn salary while he was performing the duty on a higher post. It has also been prayed that case of the petitioner be considered for promotion on the post of Block Primary Education Officer on notional basis with retrospective effect. 2.

Learned counsel for the petitioner fairly submits that he is not pressing for grant of pensionary benefits on the basis of last salary drawn by him while working on a higher post but he will be satisfied if his case for promotion on the post of Block Primary Education Officer be considered by the respondents.

Learned counsel for the petitioner, on instructions from the petitioner, submits that at this stage, he will be satisfied if a direction is given to respondent No.2 to treat the present writ petition as representation and decide the same, in a time bound manner.

Learned State counsel does not oppose the prayer made by learned counsel for the petitioner.

In view of the above and without commenting upon the merits of the case, the present petition is hereby disposed of with a direction to respondent No.2 to treat the present writ petition as representation and decide the same, within a period of two months from the date of receipt of certified copy of this order, in accordance with law.
