The petitioner is seeking regular bail in FIR No.64 dated 29.05.2015, registered under Sections 3 of the SC/ST, Act & Section 354/509 of IPC at Police Station Passiana, Patiala. Heard.

Learned counsel for the petitioner contends that the petitioner was arrested on 03.12.2015 and investigation is over and challan has been filed and the case is fixed for prosecution evidence. Learned counsel for the petitioner further contends that there is one excise case pending against the complainant and there is no case against the petitioner and the complainant had been making complaints against the petitioner and his activities and false FIR has been registered against him.

The petitioner is neighbour of the complainant and the allegations are that he used to have an evil eye on complainant's wife and used to make unnecessary comments and attempted to molest his wife.

Investigation is over and the trial will take time. Without commenting upon the merits of the case, the petition is allowed and the petitioner is directed to be released on regular bail on execution of adequate personal and surety bonds to the satisfaction of the trial Court/Duty Magistrate with a rider that he will not tamper with evidence.
