(ORAL) There is an adjournment slip circulated by learned counsel for the appellants, stating ostensibly that he has obtained no objection from the other side. However, both the learned counsels state that none of them were even informed, what to say taking of taking no objection. On the contrary, they are under instructions of their clients not to seek any adjournment since an interim stay is operating against them. This Court deprecates the practice of taking undue advantage of unilateral claim, as per adjournment slip, that no objection has been obtained. In future, learned counsel for the appellants is expected to be more cautious and do not rely on his staff without ascertaining from the learned opposite counsels.

Be that as it may, in the aforesaid premise, appeal is dismissed for non-prosecution.
