Petition under Section 528 of the BNSS, 2023 read with Section 482 of the Cr.P.C. has been filed, inter alia, for quashing of order dated 13.02.2025 (Annexure P-1), passed by learned Additional sessions Judge, Fazilka, whereby, non-bailable warrants have been issued against the petitioner.

Learned counsel for the petitioner contended that the petitioner is a senior citizen, 65 years of age and is ready to join the proceedings. It is further contended that inadvertently, the petitioner could not appear before the Appellate Court, due to which non-bailable warrants were issued against him and as such, he has challenged the order dated 13.02.2025 (Annexure P-1). It is further contended that the Area Magistrate had awarded a compensation of Rs.5,70,000/- vide impugned judgment dated 31.03.2022 (Annexure P-3) and during the pendency of the criminal appeal before the Additional Sessions Judge, Fazilka, the petitioner has already deposited the said amount in the Bank vide receipt dated 10.09.2024 (Annexure P-8) to show his bona fide.
