Present revision petition has been filed challenging the order dated 05.11.2024 whereby evidence of the plaintiff-petitioner has been closed.

Learned counsel for the plaintiff-petitioner would contend that only cross-examination of PW-6 Sandeep Singh needs to be completed as he was partly cross-examined on an earlier occasion and that some documents are to be tendered.

Notice of motion in the present case was issued on 01.05.2025, however, none has chosen to put in appearance on behalf of the respondents, despite service. Accordingly, the respondents are proceeded against ex parte. 4.

The limited prayer made by learned counsel for the plaintiffpetitioner is for completion of cross-examination of PW-6 Sandeep Singh. The suit is for permanent injunction and specific performance of agreement dated 03.08.2012. CR-2641-2025 -2and in case his cross-examination is not permitted to be completed grave injustice would be caused to the plaintiff-petitioner. 5.

In view of the above, the present revision petition is allowed and the impugned order dated 05.11.2024 stands set aside. The plaintiffpetitioner is granted one opportunity to produce PW-6 Sandeep Singh for his cross-examination as also for tendering the documents. It is made clear that since the evidence of the defendants is still going on and in case they wish to rebut the documents to be tendered by the plaintiff-petitioner, they would be at liberty to do so.

Disposed off in the above terms. Pending applications, if any, also stand disposed off.
