Keeping in view the averments enumerated in the application, which are duly supported by an affidavit, the same is allowed. Consequently, the delay of 199 days in filing the present appeal ( LPA-1091-2026 ) is condoned.

In the present appeal, the challenge is to the impugned order dated 29.08.2025 passed by the learned Single Judge, whereby the writ petition bearing CWP No. 25335 of 2025 filed by the petitioner (appellant herein) has been dismissed.

After arguing for some time, learned counsel for the appellant submits that the findings recorded by the learned Single Judge vide RIYA 2026.04.23 17:00 I attest to the accuracy and integrity of this document

CM-2665-LPA-2026 in/and LPA-1091-2026 (O&M) impugned order dated 29.08.2025 that no documentary evidence of the land which was being held by the grandfather of the appellant has been brought to the notice of the Court is incorrect as the same was already on record, hence, the present appeal may kindly be disposed of having been not pressed any further with liberty to the appellant to file a review application before the Learned Single Judge.
