CORAM:

HON'BLE MR. JUSTICE KULDEEP TIWARI

Present:

Mr. Vinod Polist, Advocate for the petitioner(s).

Mr. Shiv Kumar, Advocate, and Mr. Lovedev Singh, Advocate, and Mr. Raman Kaplish, Advocate for the respondent No.1.

*** KULDEEP TIWARI, J. (ORAL) 1.

On the previous date of hearing, i.e. 12.11.2025, this Court passed the following order:- "The issue involved for consideration in these writ petitions, was also raised in CWP-32362-2024, wherein, it was fairly conceded by learned counsel for the petitioner that the controversy has already been put to rest by a Coordinate Bench of this Court in CWP-35002-2024, decided on 10.01.2025. Further, the decision (supra) has also been upheld in LPA 10892025, and connected matters, vide which, the respondentsemployees therein, have been held entitled to gratuity for the extended period, as well.

DEVINDER YADAV 2025.11.14 09:50 I attest to the accuracy and authenticity of this order/judgment

CWP-11787-2025 (O&M) & CWP-19241-2025 Faced with the above, learned counsel for the petitioners seeks a short accommodation to have apt instructions, as to whether, the petitioners is still willing to purse the instant writ petitions.

The asked for request is accepted.

Adjourned to 13.11.2025.

To be shown in the urgent list.

It is made clear that, on the subsequent date of hearing, no request for adjournment would be entertained on behalf of either side.

A photocopy of this order be placed on the file of connected case."

2.

Today, learned counsel for the petitioner(s) fairly concedes that the issue inhering these writ petitions stands squarely covered by the ratio laid down by a Co-ordinate Bench of this Court in CWP-35002-2024, as affirmed by the Division Bench in LPA-1089-2025. He further submits that the petitioner(s) is in the process of assailing the judgment rendered in the LPA (supra) before the Hon'ble Supreme Court. Accordingly, he prays for permission to withdraw these writ petitions, with liberty to pass fresh order in the event of success in their challenge before the Hon'ble Supreme Court. 3.

Consequently, these writ petitions are dismissed as withdrawn, with liberty (supra).

4.

Pending application(s) stand disposed of accordingly. 5.

A photocopy of this order be placed on file of connected case. (KULDEEP TIWARI) November 13, 2025 JUDGE devinder Whether speaking/reasoned :
