RAMENDRA JAIN, J. (ORAL) Through this petition under Section 439 Cr.P.C. prayer has been made for grant of regular bail to the petitioner in a case arising from FIR No.170 dated 07.07.2018 registered under Section 22 of the Narcotic Drugs and Psychotropic Substances Act, 1985 at Police Station Talwandi Sabo, District Bathinda.
According to the prosecution, petitioner was apprehended with conscious possession of 700 tablets of Tredol weighing 598.50 gms. Learned counsel for the petitioner inter alia contends that as per Disability Certificate (Annexure P-2) petitioner is mentally retarded person to the extent of 40% and besides it, he is also permanently spasmine hemiparin to the extent of 50%. He is in custody since 20.06.2018. He is young boy of 24 years of age and requires regular medical treatment for his aforesaid disability. Conclusion of trial may take sufficient long time. Considering overall facts and circumstances, but without expressing any opinion on the merits of the case, the petition is allowed. Consequently, petitioner is ordered to be released on bail during pendency of trial, on his furnishing bail bonds and surety bonds to the satisfaction of Trial Court/Duty Magistrate concerned.
