This petition has been filed under Section 438 Cr.P.C. read with Section 482 Cr.P.C. for issuance of direction to the Court below to release the petitioner on bail on furnishing bail bonds in case FIR No.185 dated 1.12.202010 registered for the offence under Section 395 IPC in Police Station Model Town, Hoshairpur in in the interest of justice. Notice of motion to Advocate General, Punjab. Mr. V.P.S. Sidhu, learned Assistant Advocate General, Punjab has put in appearance on behalf of the State and accepted notice and contested the bail petition.

I have heard learned counsel for the petitioner as well as Harpal Singh Parmar 2017.02.17 17:27 I attest to the accuracy and authenticity of this document Chandigarh

Cr. Misc. No.M-5290 of 2017 [2] learned State counsel and have gone through the record. The present petitioner absented from the Juvenile Court on 28.11.2016.

Learned counsel for the petitioner states that earlier he was admitted to bail by the learned Juvenile Court, then on presentation of the challan, it was committed to the Court of Session. He argued that the present petitioner has been continuously appearing before the trial Court, but could not appear on 28.11.2016. It has been submitted that the Clerk of his counsel has inadvertently noted wrong date. As the petitioner is facing the trial and has absented on one date, no useful purpose will be served by sending the petitioner to custody till the disposal of the case. Therefore, keeping in view the above facts and circumstances, I accept this criminal miscellaneous petition and it is directed that the petitioner will surrender before the learned trial Court within ten days from today and the learned trial Court will release him on bail to its satisfaction. February 17, 2017.
