This petition has been filed under Section 482 Cr.P.C. for a direction to the respondents to transfer the investigation of case FIR No.15 dated 3.2.2016 registered for the offences under Sections 307, 506 and 341 IPC at Police Station Daba, Ludhiana to any other independent agency as the official respondents are not conducting the investigation of the case in a fair and proper manner.
At the time of arguments, learned counsel for the petitioner argued that the petitioner has been falsely implicated in the present case at the instance of respondent No.5. The petitioner was not present at the time of occurrence.
I have heard learned counsel for the petitioner and have gone HARPAL SINGH PARMAR 2016.03.28 17:16 I attest to the accuracy and authenticity of this document Chandigarh
Cr. Misc. No.M-9164 of 2016 [2] through the record.
At the time of arguments, learned counsel for the petitioner has no where given any reasonable ground for transfer of the investigation. He has not levelled any motive or enmity with the Investigating Officer or with any senior Police Officer. If the petitioner was not present at the time of occurrence and he was away at some other place, this will be looked into by the Investigating Officer. The FIR has been registered on 3.2.2016 and the investigation is at preliminary stage. The present petitioner has been named as accused in the FIR. He has not been arrested so far nor he has been granted any anticipatory bail. In other words, he has not joined the investigation so far. No ground is made out for transfer of the investigation to any other agency etc.
Therefore, finding no merit in this petition, the same is dismissed.
