The petitioner incarcerated upon his arrest in the FIR captioned above, has come up before this Court under Section 439 of the Code of Criminal Procedure, 1973 (CrPC) seeking bail. 2.

Custody certificate filed by the State counsel in Court is taken on record.

Counsel for the State opposed the present petition on the ground that in para No. 13 of the bail petition, the petitioner has mentioned that there are no other criminal case/FIR against him. However, as per the custody certificate, there are two more FIRs pending against him. CRM-M-25495-2024 -2Gautam, Additional Advocate General, Haryana has submitted that during the course of investigation, it came to the notice of investigator that a large number of criminal case are pending against the petitioner, in other states also.

Faced with the strong opposition from the State, counsel for the petitioner submits that he may be permitted to withdraw the present petition with liberty to file fresh one after disclosing all criminal cases, pending against the petitioner in Haryana as well as in other States. 5.

Given above, petition stands disposed of as withdrawn with liberty as prayed for. Pending applications, if any, stand disposed of accordingly.
