CORAM:

HON'BLE MR. JUSTICE JASGURPREET SINGH PURI * * * PRESENT Mr.Impinder Singh Dhaliwal, Advocate, for the petitioners.

JASGURPREET SINGH PURI , J. (ORAL ) The present petition has been filed under Articles 226/227 of the Constitution of India, with the prayer to issue a writ in the nature of mandamus directing respondent Nos.1 to 3 to protect the life and liberty of the petitioners by providing adequate security/police protection to the petitioners.

Learned counsel for the petitioners has submitted that petitioner No.1 (girl) is aged 29 years and petitioner No.2 boy is aged 23 years. Petitioner No.1 is unmarried whereas petitioner No.2 is married but

due to strained relations with his wife, she has filed a petition for divorce against respondent No.2 which is pending before the Court below. He has submitted that both the petitioners like each other and they wish to marry each other but parents of petitioner No.1 want to marry her with a person of their own choice and they are pressurising her to marry with somebody else and are threatening to cause injury to the life of the petitioners. She has referred to representation dated 16.7.2021 (Annexure P-3) which was given to the Senior Superintendent of Police, Sri Muktsar Sahib, stating that she has left home with her own free will as her parents are threatening that they will not spare them at any stage and will kill them and therefore, now she is residing with Gurwinder Singh under his shelter and has sought protection.

It is further submitted that petitioner No.1 who is aged 29 years is fully competent to take her own decisions to live the life of her own and now both of them are living in live-in-relationship because earlier marriage of petitioner No.2 has not been dissolved as yet by the competent Court and therefore, protection has been sought.

Notice of motion to respondent Nos.1 to 3 only. Mr.Rana Harjasdeep Singh, DAG, Punjab, accepts notice on behalf of aforesaid respondents.

I have heard the learned counsel for the parties. The scope of the present petition is confined only for the protection of life of the petitioners. This Court does not wish to make any observations on the inter-se relationship between the petitioners or the relationship between the petitioner No.2 and his wife but the scope of the

present petition is confined only for the protection of life of the petitioners. In view of above, this petition is disposed of with a direction to respondent No.2 - the Senior Superintendent of Police, Sri Muktsar Sahib, District Sri Muktsar Sahib, to consider representation dated 16.7.2021 (Annexure P-3) filed by petitioner No.l and to take the necessary action, if so required, for ensuring the protection of life of the petitioners in accordance with law. The exercise be completed within a period of one week from the date of receipt of the copy of this order. July 29, 2021.
