(Oral) Petitioner No.1 prays for grant of anticipatory bail in FIR No.57 dated 19.10.2018, registered under Sections 323, 324, 34 IPC (Section 326 IPC added subsequently) at Police Station Bhaini Mian Khan, District Gurdaspur.
The operative part of the order dated 26.11.2018, vide which interim anticipatory bail has been granted to petitioner No.1, is reproduced as under:- "....Learned counsel further submits that the allegations invoking injuries under Section 326 IPC is attributed to petitioner No.2 - Satnam Singh and petitioner No.1 - Malkit Singh is attributed simple injury. Notice of motion for 31.01.2019...."

CRM-M No.51448 of 2018 Counsel for the State, on instructions from ASI Salinder Singh, has not disputed the aforesaid fact and submits that petitioner No.1 is no more required for further investigation. In view of the above, this petition is allowed and the interim bail granted to petitioner No.1 namely Malkit Singh vide order dated 26.11.2018 is made absolute subject to the conditions envisaged under Section 438(2) Cr.P.C.
