This is the fourth petition for grant of bail, pending trial, in a criminal case arising from FIR No.112, dated 12.05.2018, registered under Section 22 of the NDPS Act, 1985, at Police Station Sadar Khanna, District Ludhiana.
The second petition filed by the petitioner was dismissed on 28.10.2020.
Thereafter, another application was dismissed on 28.01.2021 with the following order:- This is third petition for grant of bail pending trial in a criminal case arising from FIR No.112, dated 12.05.2018, registered under Section 22 of the Narcotic Drugs and Psychotropic Substances Act, 1985, at Police Station Sadar Khanna, District Ludhiana.
On 28.10.2020, the previous petition filed for grant of bail was dismissed with the following order:- "The petitioner prays for grant of regular bail pending trial in a criminal case arising from FIR No. 112 dated 12.05.2018, registered under Section 22 of the
CRM-M-29934-2021 (O&M) Narcotic Drugs & Psychotropic Substances Act, 1985 (hereinafter referred to as "the 1985 Act") at Police Station Sadar Khanna, Ludhiana.
The first petition for grant of regular bail was allowed on 08.10.2018, granting interim bail to the petitioner till the report from the Forensic Science Laboratory is received. The aforesaid report has been received.
As per the case of the prosecution, the petitioner was allegedly found in possession of 2500 intoxicating capsules. The average weight of each capsule is 636 mg. As per the trial Court, the total recovery would fall within the category of commercial quantity.
Keeping in view the aforesaid facts, no ground is made out to grant the concession of regular bail to the petitioner. Hence, the present petition is dismissed." Learned counsel for the petitioner, although, made a sincere attempt, however, failed to draw the attention of the court to any fresh ground for bail.
Hence, dismissed.
However, learned trial court is requested to make a sincere endeavour for expeditious disposal of the trial. The learned counsel representing the petitioner although made a ASHOK KUMAR 2021.08.06 10:49 I attest to the accuracy and integrity of this document sincere attempt, however, failed to draw the attention of the Court to any fresh ground for grant of bail.
Dismissed.
