ARUN MONGA, J. (ORAL) 1.

Prayer in the instant civil revision, inter alia, is for setting aside order dated 17.02.2020, passed by the Executing Court below allowing the objections filed by respondent-Judgment Debtor. Resultantly, execution petition filed by the petitioner-decree holder, seeking implementation of the order dated 06.03.2018 passed by the Appellate Court, has been disposed of/dismissed. The parties have been left to settle their lis as per Circular No. D45/2017 issued by respondent-Nigam. 2.

Learned counsel for respondent Nigam, at the very outset, submits that entire dispute herein would be rendered needless only if petitioners approach the Sub Divisional Officer(Operations), Hisar for settlement of dispute as per Circular No.D-45/2017, ibid. He submits, under instructions, that the concerned Officer shall take a fresh decision within a period of 15 days of him being approched.

Learned counsel for the petitioner also does not object to the aforesaid suggestion of learned counsel for respondent Nigam. 4.

In the premise, impugned order dated 17.02.2020(Annexure P-11) passed by Executing Court below is set aside with liberty to the petitioners to approach the Officer concerned for de novo settlement of dispute as per Circular D-45/2017. The Officer concerned shall pass appropriate fresh orders within 15 days of receipt of such request/ application. Needless to say, petitioners would be at liberty to challenge the fresh order, if still feel aggrieved.
