Petitioner has filed this petition under Section 438 Cr.P.C. for grant of anticipatory bail in case FIR No.259 dated 30.03.2016 under Sections 420, 406, 467, 468, 471 and 120-B IPC, registered at Police Station Hisar City, District Hisar.
Notice of motion was issued and learned State counsel appeared and contested the petition.
I have heard learned counsel for the petitioner as well as learned State counsel and have gone through the record. From the record, I find that in the present case, FIR has been registered against Ashok Kumar and Pooja Bansal, his wife for committing fraud, forgery and cheating. CRM No.M-5399 of 2017 -2petitioner is that he obtained loan of `52,72,094/- on the basis of sale deed produced before the bank bearing No.2463 dated 06.07.2015 and when he committed default in repaying the loan, a verification was made and it was found that he has obtained loan on the basis of forged and fabricated sale deed.
I have also seen the police record. The sale deed bearing No.2463 is dated 10.07.2015 and is qua some other person. Keeping in view the facts and circumstances of the present case, I find that the present petitioner is required for custodial interrogation and investigation.
Therefore, finding no merit in the present petition, the same is dismissed.
