This revision petition under Article 227 of the Constitution of India has been filed by the plaintiff-petitioner aggrieved by the order dated 25.04.2024 passed by the learned Civil Judge (Junior Division), Garhshankar, whereby two applications moved by the plaintiff under Order 26 Rule 9 CPC for appointment of Local Commissioner and an application under Section 151 CPC for directing the SHO, P.S. Garhshankar to comply with the stay order dated 20.02.2024 (Annexure P-4), have been dismissed. 2.

It is not disputed that alleging violation of the order dated 20.02.2024 (Annexure P-4), the petitioner has already moved an application SHRUTI 2024.07.17 12:26 I attest to the accuracy and integrity of this order/judgment.

under Order 39 Rule 2A CPC, which is pending consideration before the concerned Court.

After arguing for sometime, learned counsel for the petitioner seeks withdrawal of the present petition with liberty to approach the trial Court for expeditious disposal of the application filed under Order 39 Rule 2A CPC.
