The petitioner through instant petition under Articles 226/227 of the Constitution of India is seeking setting aside of selection/recommendation of respondent No.4.

Mr. Ashish Kapoor, Advocate submits that respondent No.4 has set up and commenced its petrol pump on 31.10.2007. The selection of respondent No.4, at this belated stage, ought not to be cancelled. 3.

The petitioner filed present petition in 2007 assailing selection of respondent No.4. In the same year, respondent No.4 set up its petrol pump. 4.

This Court finds substance in the statement of respondents that at this belated stage, it would not be just and fair to cancel selection of respondent No.4 on the grounds raised by the petitioner.
