*** NIDHI GUPTA, J. (ORAL) Challenge in the present petition is to impugned judgment dated 10.12.2014 passed by learned Additional Sessions Judge (Adhoc), Fast Track Court, Gurdaspur in Crl. Appeal No. 108 of 2013 titled as 'State through Harjit Kaur vs. Santokh Singh and others', whereby the appeal against the judgment dated 19.11.2013 passed by learned Judicial Magistrate 1st Class acquitting the private respondents herein, Gurdaspur in case FIR No. 25 dated 08.02.2009 registered under Sections 498-A, 494, 406, 323 IPC at Police Station City Gurdaspur, has been dismissed. The matter pertains to the year 2015. Perusal of the order sheets shows that there was no representation on behalf of the petitioner on the last 3 dates of hearing i.e. 17.09.2015, 28.07.2016, 10.11.2016. Thereafter, the matter was adjourned sine die vide order dated 23.02.2017 passed by a Coordinate Bench of this Court. CRR-1114-2015 (O&M) - 2i.e. 13.02.2024, none appeared on behalf of the petitioner and Registry was directed to inform learned counsel for the petitioner about the next date of hearing. Today, Mr. Navjeet Sodhi, Advocate puts in appearance and submits that the case file was taken back by the petitioner wayback in the year 2016 and, hence, he is not representing the petitioner. Therefore, it can safely be presumed that the petitioner or his counsel is not interested in pursuing the present petition.
