RAJESH BHARDWAJ, J.(ORAL) Petitioner has approached this Court praying for issuance of direction to the respondents to implement the decision/letter dated 29.08.2019, Annexure P-4, whereby Administrative approval for expenditure of Rs.5.47 lakhs for construction of street through convergence from Hadda Rori till the house of Hardev Singh son of Inder Singh under MGNREGA, shown in pink colour in site plan, Annexure P-1, has been granted but due to party faction in the village, the Gram Panchayat has not started any work at the spot resulting in the lapse of grant. It is further prayed to issue directions to the respondents to consider and take a final decision on petitioner's representations, dated 25.07.2020, Annexures P-5 to P-9, within short stipulated period, by passing a speaking and well reasons order.

CWP-12892-2020 -2Learned counsel for respondent No.7-Gram Panchayat submits that as per MGNREGA Scheme firstly construction of path has to be completed and then the necessary bills are to be submitted for reimbursement of the same. He has submitted that as of now the Panchayat does not have any funds for investing in construction of path, as prayed by the petitioner, however in future as and when the necessary funds would be available, the prayer made by the petitioner would be appreciated and the necessary work would be carried out in accordance with law. In view of the statement made by learned counsel for respondent No.7-Gram Panchayat that the work regarding construction of the path will be initiated as and when the funds are available in accordance with law, the present petition is disposed of. However, the petitioner would be at liberty to pursue his remedy as available to him in case any further cause of action accrues to him.
