Main Case 1.

The present revision petition has been filed under Article 227 of the Constitution of India for setting aside the impugned order dated 05.03.2026 (Annexure P-5) passed by the learned Civil Judge (Senior Division), Kurukshetra, whereby the learned Civil Judge closed the evidence of a summoned witness on account of his non-appearance. 2.

The brief facts of the case are that the respondent-Vineet Sehgal instituted a suit for recovery of ₹26,03,697/- along with interest @ 9% per annum w.e.f. 17.08.2015 till its realization, against the petitioners-Star Associates through its proprietor and another. Notice of the suit was duly served upon the petitioners, who contested the same by filing their written statements. Issues were thereafter framed and the plaintiff/respondent led his ANIL KUMAR 2026.05.05 17:20 I attest to the accuracy and integrity of this document

CR-3474-2026 (O&M) evidence. Subsequently, the case was fixed for evidence of the petitioners/defendants.

Mr. Aayush Gupta, Advocate, has put in appearance and accepted notice on behalf of respondent-Vineet Sehgal, and submits that he has no objection in the event the petitioner is granted an opportunity to examine the witness-Subhash Chander at his own responsibility. 5.

I have heard learned counsel for the parties and have perused the paper book.

Keeping in view the statement made by counsel for the respondent and without commenting anything on the merits of the case, the present revision is disposed of and the impugned order dated 05.03.2026 is set aside. Petitioner is directed to appear before the learned Civil Judge (Sr. Divn.), Kurukshetra, on the date fixed, and thereafter, the learned Civil Judge (Sr. Divn.), Kurukshetra, is directed to afford one effective opportunity to the petitioner to examine the witness-Subhash Chander at its own responsibility. 7.

Pending applications, if any, shall stand disposed of. 8.

Registry is directed to send a copy of this order forthwith to the learned learned learned Civil Judge (Sr. Divn.), Kurukshetra, for strict compliance.
