Status report received which goes to show that till date only one PW has been examined. The pace of the trial seems to be slow. The State counsel submits that a direction be issued to the trial Court and prosecution would examine all the PWs on that date. Accordingly, the next date fixed i.e. 2.11.2017 seems to be quite short and it may not be possible to issue summons for remaining PWs to get their service effected and to cause their appearance in the Court. It is directed that trial court would fix a date of about one month issuing summons for remaining PWs and it would be duty of the prosecution to get the service effected upon those PWs and then to cause their appearance in the Court. The trial Court would examine all the PWs present on that date. CRM-M No. 5471 of 2017 three weeks be fixed and earnest efforts be made to conclude the evidence of the prosecution and thereafter by fixing a short date after recording statement of the accused, examining defence witnesses and hearing arguments to finally conclude the trial.

Faced with such situation, learned counsel for the petitioner states that he be allowed to withdraw the petition. Dismissed as withdrawn.
