The present petition has been filed under Section 438 Code of Criminal Procedure for grant of anticipatory bail to the petitioners in case FIR No.69 dated 30.5.2017 registered for the offences punishable under Sections 302, 148, 149 of IPC at Police Station Guruharsahai, District Ferozepur.

Heard.

Learned counsel for petitioners submits that apprehension of the petitioners that charge may be framed against them for offence punishable under Section 302 IPC instead of Section 306 IPC already framed by the trial court is based on the application moved by the prosecution. However, the charge has not been amended and the application of the prosecution has not been allowed so far.

Keeping in view the above facts, this petition is disposed of with direction to the trial court to allow 10 days time to the petitioners to move application for grant of regular bail in the event of charge for offence punishable under Section 302 IPC being framed against them.
