(Oral) The present petition has been filed by petitioner-Vikas @ Vicky under Section 439 Cr.P.C. for grant of regular bail to him in case FIR No.140 dated 20.09.2018 registered under Sections 21, 22 of the Narcotic Drugs and Psychotropic Substances Act, 1985 at Police Station Ding, District Sirsa, Haryana.
Learned counsel for the petitioner submits that the FSL report has not been received so far and challan has been presented without having the FSL report. Co-accused of the petitioner, namely, Gurwinder Singh @ Sethi, Kuldeep Singh @ Gauri and Sunil Kumar have been released on interim bail till the receipt of FSL report.
Learned State counsel on instructions from SI Wazir Singh has not disputed the release of co-accused on interim bail as well as the fact that FSL report has not been received so far. Heard.

In view of the submissions made by learned counsel for the petitioner that the FSL report has not been received so far and challan has been presented without having the same; three co-accused of the petitioner have been released on interim bail till the receipt of FSL report, the petitioner (Vikas @ Vicky) is directed to be released on interim bail till the receipt of FSL report subject to his furnishing bail/surety bonds to the satisfaction of the trial Court.
However, the petitioner is directed to surrender before the trial Court on receipt of FSL report. In case, the quantity is commercial, the petitioner is at liberty to move application for bail afresh. Disposed of accordingly.
