On asking of the Court, Mr. Kiran Pal Singh, AAG, Haryana accepts notice on behalf of the State. Learned counsel for the petitioner shall supply copy of the petition to learned State counsel by today itself. Petitioner is seeking issuance of direction to the respondent to conduct fair and transparent online transfer driver for all Assistant District Attorneys by displaying all the vacancies in the vacant station list. Mr. B.R. Mahajan, Advocate General Haryana, who is present in the Court submits that pursuant to transfer drive from 12.02.2019 to 27.02.2019, the petitioner had exercised 12 options which includes Karnal, Panipat and others with respect to particular station but that transfer drive has been cancelled due to some technical glitches and again it was opened from 14.05.2019 to 23.05.

2019 and the petitioner approached this Court with the prayer that earlier option which was available to the petitioner, is not available in the present transfer drive. Mr. B.R.Mahajan submits that per the clause 7 (v) of online transfer policy, it has been stated that some vacancies of all categories of law officers Gaurav Arora 2019.05.

CWP No. 13759-2019 may remain unfilled at any given point of time due to shortage of law officers in the department. To avoid disproportionate concentration of Law Officers in some office, the department may block some actual posts to be kept vacant in the transfer drive.

Mr. B.R. Mahajan further states that 169 stations are available for online transfer drive and the petitioner can participate in the same. It has further been stated that stations have been blocked for unmarried female employees and to avoid disproportionate concentration of law officers in some offices. In view of the above factual position, the petitioner cannot given an option of a particular department.

The petition stands disposed of with a liberty to the petitioner to exercise her option against 169 stations, which have been displayed on the website.
