While granting interim bail to the petitioner, this Court passed the following order on 24.08.2021:- "The instant petition has been filed under Section 438 of Cr.P.C., for grant of anticipatory bail to the petitioners in FIR No.127 dated 22.08.2019 under Sections 366/376D/365/342/506/120-B of IPC registered at Police Station ADivision, Amritsar District Amritsar. Learned counsel for the petitioner herein would contend that the petitioner has been falsely implicated in the said FIR as would be evident from the fact that an inquiry was

{2} conducted by the DSP East Amritsar on the allegations made and he was kept in column No.2 while a challan was presented against the main accused namely Gurjit Singh @ Romi. It is only on account of an application having been filed under Section 319 Cr.P.C. that the petitioner herein has been summonned to face trial. It is further argued that the custodial interrogation of the petitioner would no longer be required in the instant matter as the DSP has already investigated the issue and declared him innocent. Learned counsel would further submit that he is ready to face trial and prays for grant of anticipatory bail to the petitioner.

Notice of motion.

Mr. A.S.Gill, Senior DAG, Punjab, appearing through the medium of video conferencing, accepts notice on behalf of the respondent- State and seeks some time to file reply. Since the petitioner herein had already joined the investigation and the challan stood presented where he had been kept in column No.2, I deem it appropriate to stay his arrest limited for a period of 10 days to unable (sic enable) him to put in his appearance before the trial Court where on moving an appropriate application he will be admitted to interim bail subject to his furnishing personal and surety bonds to the satisfaction of the trial Court.

State has not filed any reply.

Upon instructions from ASI Shamsher Singh, State counsel submits that the petitioner has surrendered and is appearing before the trial Court.

In view of the above facts, but without commenting on the merits of the case, the present petition is disposed of and the order dated 24.08.2021 granting interim bail to the petitioner is made absolute.
