(Oral) (1) At the outset, learned counsel for the petitioner submits that he restricts his prayer to the issuance of directions to respondent No.2-Deputy Commissionercum-District Magistrate, Jalandhar to finally dispose of the recommendations made by the Jail Authorities, Central Jail, Kapurthala, on which verification report was sent by SSP, Jalandhar (Rural) to the Deputy Commissioner-cum-District Magistrate, Jalandhar on 25.09.2024 for grant of parole to the petitioner. (2) Learned State counsel has no objection to the acceptance of the afore alternate prayer made on behalf of the petitioner.
(3) After hearing learned counsel for the parties and going through the record, we find that the decision on the petitioner's request for grant of parole has been unnecessarily delayed by the State which is also against the spirit behind Section 3 of the Punjab Good Conduct Prisoners (Temporary Release) Act, 1962. (4) In the light of the above, we dispose of the instant petition with a direction to respondent No.2 to take a final decision on the petitioner's request made in the year 2023 on which recommendations were made to respondent No.2 on 25.09.2024 for the grant of parole, within one week from the date of receipt of a copy of this order, in accordance with law.
