Prayer is for grant of anticipatory bail in case FIR No.1127 dated 08.11.2018 under Sections 406,420 IPC registered at P.S Hisar Sadar, District Hisar.
Allegations against the petitioner are that he had received a sum of Rs.11 lacs from the complainant on the pretext of getting his son recruited in the police.
Learned counsel for the petitioner contends that the petitioner has been falsely implicated in the present case. Though the petitioner had received the amount but it was not for providing job. He contends that the complainant had also lent the money to various other persons including the petitioner. The amount lent to the petitioner has been repaid by him though no receipt was acknowledged by the complainant. He argues that the matter has been investigated at the level of the Deputy Superintendent of Police and the petitioner's version was found to be correct. CRM-M-51603 of 2018 #2# demonstrate his bonafide, the petitioner has already deposited a sum of Rs.9 lacs with the Registry.
A perusal of file reveals that the matter was also referred to the Mediation and Conciliation Centre of this Court twice, however, no settlement could be arrived at between the parties. Vide order dated 26.11.2018, this Court while granting the concession of interim anticipatory bail directed the petitioner to join investigation.
Learned State counsel states that the petitioner, in terms of the said order, has joined the investigation and his custodial interrogation is no longer required.
In view of above, the petition is allowed. The order dated 26.11.2018 granting interim anticipatory bail to the petitioner, is made absolute. However, the petitioner shall join the investigation as and when called upon to do so by the Investigating Agency and shall abide by the conditions of Section 438 (2) Cr.P.C.
