***** SANJEEV PRAKASH SHARMA, J (ORAL) Prayer in the present petition filed under Section 439 Cr.P.C. is for grant of regular bail to the petitioner in FIR No.411 dated 11.12.2021 under Sections 376-D, 341, 328, 506 and 120-B IPC and Section 67-A of the IT Act, registered at Police Station Punhana, District Nuh. Learned counsel for the petitioner submits that the petitioner has been falsely implicated in the case.

Learned State counsel, on the other hand, has opposed the present petition for grant of regular bail and submits that the allegations against the petitioner are serious.

This Court has heard learned counsel for the parties and has perused the paper book.

Taking into consideration the allegation relating to the gang rape as alleged by the prosecutrix which she has also affirmed in her statement recorded under Section 164 Cr.P.C. and keeping in view the fact DINESH BANSAL 2023.05.30 16:21 I attest to the accuracy of this order Chandigarh

CRM-M-26148-2023 -22023:PHHC:078201 that in the revision filed by the prosecutrix, the Court had already issued summons to five persons who were not made accused by the police and the specific allegation levelled against the petitioner, this Court is not inclined to grant bail to the petitioner.

Accordingly, the petition is dismissed.
