On 27.05.2019 while issuing notice of motion, the respondent was directed to revert the petitioner. Order dated 27.05.2019 reads as:- "

Learned counsel is seeking quashing of show cause notice dated 15.05.2019 (P-5) on the ground that the same has been passed without taking into consideration the order dated 03.10.2018 (P-3).

Learned counsel contends that vide order dated 15.07.2015, the petitioner was awarded punishment of stoppage of five annual increments with permanent effect and also ordered down grading of ACR for the period 2014-15. On appeal, the punishment was reduced to stoppage of two future annual increments with permanent effect (P-2). On revision, the punishment was reduced to that of censure (P-3) and the petitioner was subsequently promoted as ASI.

CWP No.14263-2019 (O&M) -2Learned counsel submits that once the petitioner has been promoted after taking into consideration his ACR's and thereafter, now the show cause notice dated 15.05.2019 (P-5) seeking reversion of the petitioner is liable to be set aside.

Notice of motion for 23.10.2019.

Till the next date of hearing, the petitioner shall not be reverted."

Learned State counsel submits that petitioner has retired as ASI on attaining the age of superannuation, thus, petition has rendered infructuous.

Learned counsel for the petitioner does not dispute the aforestated legal and factual position. 4.

In the wake of statement of both sides, the petition stands disposed of as having been rendered infructuous. 5.
