(ORAL) Through this petition under Section 439 Cr.P.C. prayer has been made for grant of regular bail to the petitioner in a case arising from FIR No.0123 dated 02.07.2018, under Sections 307, 353, 186 IPC, Sections 25/27 Arms Act and Section 22 of the NDPS Act, 1985, Police Station Division No.3, District Police Commissionerate, Jalandhar.

According to the prosecution, petitioner had accompanied main accused Sohan Lal @ Sonu to Roorke to purchase illicit arms. Learned counsel for the petitioner contends that the petitioner is in custody since, July, 2018. He was not apprehended on the spot. He has falsely been implicated in the instant case. Considering overall facts and circumstances, but without expressing any opinion on the merits of the case, the petition is allowed. Consequently, petitioner is ordered to be released on interim bail till conclusion of trial, on his furnishing bail bonds and surety bonds to the satisfaction of Trial Court/Duty Magistrate concerned.
