RUPINDERJIT CHAHAL, J. (ORAL) 1.

Through the instant petition filed under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (For short "BNSS"), the petitioners seeks anticipatory bail in case FIR No.251 dated 08.11.2025 under Section 420 registered at Police Station Division No.6, District Ludhiana. 2.

Learned counsel for the petitioners submits that in compliance of the order dated 21.04.2026 passed by this Court, the petitioner has joined the investigation.

On 21.04.2026, following order had been passed: - "

Prayer in the present petition filed under Section 482 of the BNSS, 2023 is for grant of anticipatory bail to the petitioner in case FIR No.251 dated 08.11.2025 registered under Section 420 IPC at Police Station Division No.6, Ludhiana. Learned counsel for the petitioners contends that the petitioners have been falsely implicated in the present case. He submits that the present case has been registered by misreprsentation and concealment of the facts due to political influence. He submits that the applicants never entered into any agreement to sell with the complainant or her husband and the present case has been lodged just to pressurise them. No recovery is to be effected from the petitioners. He further submits that the

-2petitioners were granted concession of anticipatory bail by learned Trial Court vide order dated 01.12.2025 and were directed to join the investigation within 15 working days from that day, however, the petitioners could not join the investigation in pursuance to the directions issued by the learned Trial Court and as a consequence the aforesaid order was made inoperative by the learned Trial Court vide order dated 16.04.2026.

Learned counsel for the petitioners submits that petitioners be given an opportunity to join the investigation again by taking a lenient view. Learned counsel for the petitioners further submits that the petitioners are willing to join the investigation as and when called upon to do so by the investigating agency. Notice of motion.

On asking of the Court, Mr. Gurpartap Singh, AAG Punjab accepts notice on behalf of respondent-State and seeks time to file status report in the matter. However, he has not controverted the fact that the petitioners were given concession of anticipatory bail by the learned Trial Court but could not join the investigation within the stipulated time.

List on 01.05.2026.

In the meantime, the petitioners are directed to join the investigation within a week from today and would appear as and when required by the Investigating Officer and cooperate with the Investigating Agency. In the event of arrest, they shall be admitted to interim bail on furnishing of bail/surety bonds to the satisfaction of Arresting/Investigating Officer. The petitioners shall also abide by the conditions as envisaged under Section 482(2) of BNSS, 2023."

Learned counsel for the State, on instructions from ASI Balraj Singh, has submitted that the petitioner has joined the investigation and is no longer required for further investigation. 5.

At this stage, Mr. Tarang Goyal, Advocate has put in appearance on behalf of the complainant and has filed his power of attorney. The same is taken on record. He has opposed to the relief sought by the petitioner and prays that the present petition be dismissed. 6.

In view of the statement made by learned State counsel, the interim order dated 21.04.2026 is made absolute. The petitioner shall

-3continue to join investigation, as and when called by the Investigating Officer and shall also abide by the conditions as provided under Section 482(2) of the BNSS.
