(ORAL) Prayer in this petition under Section 439 Cr.P.C. is for grant of regular bail to the petitioner in case FIR No. 117 dated 01.12.2023 registered under Sections 34, 376(2)(n), 377, 506 of Indian Penal Code, 1860 (Sections 27 & 30 of Arms Act were added later on) at Women Police Station, District Charkhi Dadri, Haryana.

Custody certificate dated 26.05.2024 filed in Court today is taken on record, as per which, the petitioner has undergone the custody period of 05 months and 15 days as an undertrial. After arguing for sometime, when this Court is not inclined to accord the benefit of regular bail to the petitioner; learned counsel submits that he may be permitted to withdraw the present petition, at this stage. Permitted to do so.

Dismissed as withdrawn, at this stage.
