M.M.S. BEDI, J (ORAL) Petitioner claims that despite his specific statement attributing role to respondent Nos.2 to 4, the application under Section 319 Cr.P.C., has been dismissed.

After hearing the counsel for the petitioner, it appears that petitioner's real brother Chhotu Ram has already appeared as a witness and turned hostile. The other witnesses Kuldeep Singh and Sandeep Singh seem to have not been examined.

In view of said circumstances, counsel for the petitioner seeks permission to withdraw the present petition. Dismissed as withdrawn, at this stage, with liberty to approach this Court after recording of statements of other material witnesses.
