ARVIND SINGH SANGWAN, J. (Oral) The petitioner prays for grant of anticipatory bail in FIR No.120 dated 30.09.2018, registered under Sections 457, 380, 413 of the Indian Penal Code (in short 'IPC') at Police Station City Jalalabad, District Fazilka.

As per the allegations in the FIR, the complainant has stated that in his absence from his house, theft was committed in which household articles as detailed in the FIR, were stolen by breaking open the lock of the gate. It is further stated that even the window panes of the car were broken and certain car accessories were also stolen. It is further stated in the FIR that the complainant at his own was looking for the accused persons and later, came to know that theft was committed by 03 persons i.e. the petitioner - Happy Singh @ Hardeep Singh, Gurnam Singh @ Gummi and Desh Singh.

CRM-M No.51714 of 2018 is an innocent person and there is some delay in registration of the FIR and even in para 4 of the petition, it is stated that the petitioner is not involved in any other case.

Counsel for the State, on instructions from SI Prem Lal has, however, submitted that the petitioner is involved in one more case i.e. FIR No.125 dated 26.10.2018 under Sections 457 and 380 IPC registered at Police Station City Fazilka and the petitioner is wanted in the said FIR, as well.

Considering the serious allegations of theft against the petitioner and 02 other co-accused and also in view of the fact that the petitioner is involved in one more FIR, a fact which is concealed in the present petition, and also considering the gravity of the offence, I find no ground to grant the relief of anticipatory bail to the petitioner. Dismissed.
