 &&&&  % & Petitioners-Harvinder Singh alias Ganja and Tejpal Singh alias Sona have filed this petition under Section 439 of the Code of Criminal Procedure, 1973 for grant of regular bail in case vide DDR No.18, dated 30.09.2016, under Sections 307, 341, 148 and 149 of Indian Penal Code and Section 25 and 27 of Arms Act at Police Station Kamboj Amritsar registered in FIR No.133 dated 20.08.2016.

Notice of motion was issued in this case.

Learned State counsel appeared and contested the instant petition.

I have heard learned counsel for the petitioners as well as learned State counsel and gone through the record. From the record, I find that as per the allegations both the petitioners were armed with pistols and fired towards complainant's party, in Rajesh Kumar 2017.03.21 17:02 I attest to the accuracy and authenticity of this document.

 which, Tejpal Singh alias Bittu received two fire arm injuries one on the chest and another on the thigh. The challan in the present case has not been presented so far. The case is at preliminary state. Therefore, there is every chance of tampering with the evidence.

Keeping in view the facts and circumstances of the present case and in view of the nature and gravity of the offence, I do not find it a fit case, where the petitioners are entitled to the benefit of regular bail. Therefore, finding no merit in the present petition, the same is dismissed.
