Status report dated 08.05.2023 by way of affidavit of Sh. Ajinder Singh, Superintendent of Police (HQ), SAS Nagar Mohali as well as custody certificate dated 05.05.2023, filed by learned counsel for the State, are taken on record.

The petitioner has filed the present petition under Section 439 Cr.P.C., for grant of regular bail in case FIR No. 85 dated 26.02.2021 registered under Sections 18 and 22 of the NDPS Act and Sections 489-A, 489-B and 489-C IPC at Police Station Zirakpur, RISHU KATARIA 2023.05.09 13:57 I attest to the accuracy and authenticity of this order/judgment

On instructions, learned counsel for the State submits that the trial is at the fag end, as all the prosecution witnesses have been examined.

In para 18 of the status report, it has been averred that out of total 11 prosecution witnesses, 7 have already been examined and out of which only PW-1 HC Rooplal has been cross-examined by the learned defence counsel whereas examination-in-chief of PW-2 to PW-7 had been recorded but their cross-examination is yet to be done by the defence counsel. It has further been averred that 3 prosecution witnesses have already been given up by the prosecution. 5.

In view of the above, learned counsel for the petitioner submits that he may be permitted to withdraw the instant petition. 6.

Dismissed as withdrawn.
