While facing trial, the petitioners remained absent from 18.10.2014 till February, 2015, raising a reasonable apprehension of arrest as non bailable warrants were issued against them. Pursuant to the interim order passed by this court, petitioner Nos.1 and 3,namely, Shanu Sharma and Ashish Sharma have already appeared before the trial court and granted the concession of interim bail. So far as petitioner No.2 Ajay Kumar, is concerned, he has not put in appearance before the trial court.

In view of the above circumstances, petition qua petitioners 1 and 3, namely, Shanu Sharma and Ashish Sharma is allowed. Interim order passed qua petitioners 1 and 3 is hereby made absolute. Petitioners 1 and 3 will remain on bail against the bail bonds already furnished and will continue to appear before the trial court. So far as petitioner No.2 Ajay Kumar is concerned, he having not appeared before the trial court, pursuant to the interim order passed by this court, he will not be entitled to any relief. Petition on behalf of petitioner No.2 Ajay Kumar is dismissed. However, it is observed that in case Ajay Kumar puts an appearance before the trial court within a period of one month, his bail application will be decided within a period of three days.

Interim order qua petitioner No.2 Ajay Kumar is vacated. May 17 ,2016 ( M.M.S.BEDI ) TSM JUDGE
