Mr. Anil Dutt Sharma, Advocate accepts notice on behalf of the non-applicant/respondent Nos.1 to 5 and states that he has no objection if the present application is allowed and the main case is permitted to be withdrawn.

In view of the above and for the reasons stated in the application, the same is allowed. With the consent of the learned counsel for the parties, the main case (FAO-3376-2019) is taken on Board today itself. FAO-3376-2019 5.

2024:PHHC:020228 FAO-3376-2019 (O&M) -2permission to withdraw the present appeal. Learned counsel states that pursuant to the impugned award dated 15.02.2019, the awarded amount was deposited and disbursed to the claimant-respondent Nos.1 to 5 and the execution petition was dismissed as withdrawn vide order dated 17.07.2019. He further states that statutory amount of Rs.25,000/- which was deposited at the time of the filing of the present appeal may be refunded to the appellant-insurance company.

Dismissed as withdrawn. Statutory amount, if lying deposited be released to the appellant. Pending applications, if any, also stand disposed off.
