State of Punjab .............Respondent CORAM: HON'BLE MR.JUSTICE JASWANT SINGH Present:- Mr.GS Sawhney,Advocate for the petitioner Mr.Mikhil Kad,AAG Punjab Jaswant Singh,J.(Oral) Present revision has been filed by the convict petitioner assailing the judgment dated 25.11.2013 passed by learned Additional Sessions Judge, SBS Nagar whereby the appeal of the petitioner/accused against judgment and sentence order dated 15.4.2013 passed by learned JMIC,SBS Nagar convicting and sentencing him for 2 years' RI for offence under Section 420 IPC has been upheld.
This Court vide order dated 20.1.2014 had issued notice only qua quantum of sentence.
Thereafter on the plea of effecting a compromise with the complainant this Court vide order dated 5.8.2014 granted one month's interim bail to the petitioner. In compliance of the said order the learned CJM,Nawanshahar granted one month's bail to the petitioner. CRR 4047/2013(O&M) Since last more than one year petitioner has neither shown any efforts to arrive at an amicable settlement nor surrendered before the Court on expiry of one month's interim bail.
In fact, till today the petitioner has managed to stay out of jail where he ought to have been after September 2014. Learned counsel prays for one opportunity to surrender before the Court and seek regular bail.
In the light of aforesaid conduct of the petitioner, no ground to even interfere on quantum of sentence much less for permitting him regular bail is made out.
At this stage,learned counsel seeks permission to withdraw the petition.
Dismissed as withdrawn.
