RAMENDRA JAIN, J. (ORAL) Prayer in the instant petition under Section 482 Cr.P.C. has been made for quashing FIR No.178 dated 16.11.2017 registered under Sections 294, 341, 323, 148 and 149 IPC, at Police Station Jodhan, District Ludhiana (R) and all consequential proceedings arising therefrom, on the basis of compromise dated 28.11.2017 (Annexure P-2) arrived at between the parties. Pursuant to order dated 26.11.2018 of this Court, the parties appeared before the trial Court on 10.12.2018 to get their statements recorded. Learned Judicial Magistrate Ist Class, Ludhiana, has submitted his report vide letter bearing No.224 dated 14.12.2018 duly forwarded by learned District and Sessions Judge, Ludhiana, vide letter No.1157/EC dated 20.12.2018. According to the report, learned Judicial Magistrate Ist Class, Ludhiana, is satisfied that parties have compromised the RAVINDER SINGH 2019.01.10 13:37 I attest to the accuracy and authenticity of this document

-2CRM-M-51820 of 2018 matter with their free will and without any pressure and influence, thus, the same is genuine, voluntary and valid. No accused has been declared proclaimed offender.

Considering the report of learned Judicial Magistrate Ist Class, Ludhiana, dated 14.12.2018 and the fact that the compromise will bring peace and harmony in relations between the parties, aforesaid FIR No.178 dated 16.11.2017 and all subsequent proceedings arising therefrom, are quashed, subject to payment of costs of `15,000/-, out of which `12,000/- shall be deposited with the Poor Patients' Welfare Fund of the Postgraduate Institute of Medical Education and Research (PGIMER), Chandigarh and `3,000/- with the Bar Association, Punjab and Haryana High Court, within one week from today, failing which this petition shall be deemed to be dismissed.

Disposed of accordingly.

List on 12.02.2019, for production of receipt with regard to deposit of aforesaid costs.
