Learned counsel for the petitioner submits that the present revision petition has been filed against the acquittal of the respondent ordered by the Courts below in the private complaint. The appropriate remedy was to file the appeal under Section 372 Cr.P.C. along with a application for seeking leave to file an appeal. Learned counsel submits that he may be permitted to withdraw the present petition with liberty to the appellant to avail the remedy of appeal.
