 ,  *%  ' After having heard learned counsel for the appellant, there appears to be no dispute with respect to the fact that appeal is rendered infructuous due to efflux of time. However, the only issue survives which is being pressed by learned counsel for the appellant is imposition of costs by the learned Single Judge.

Considering the facts and circumstances in its entirety, while disposing this appeal as infructuous we find that since imposition of costs was unwarranted and unjustified, we set.aside that order of the learned Single Judge whereby a costs of Rs.50,000/. was imposed upon the appellant.

Appeal accordingly stands disposed of.
