***** SANJEEV PRAKASH SHARMA, J (ORAL) Prayer in the present petition filed under Section 439 Cr.P.C. is for grant of regular bail to the petitioner in FIR No.541 dated 03.12.2022 under Sections 323, 34, 341, 354-B, 354-C, 365, 506 and 511 IPC (Sections 324, 326 and 427 IPC added later on), registered at Police Station Sampla, District Rohtak.

Learned counsel for the petitioner submits that the petitioner has been falsely implicated in the case and he is in custody since 21.12.2022. He further submits that the petitioner is not required for further investigation and charge-sheet has been filed. The weapons used was also recovered. Learned counsel for the petitioner further submits that co-accused Jaideep was granted by the trial Court and case of the petitioner is on the similar footing as that of Jaideep. However, this Court is not inclined to consider that aspect, at this stage. CRM-M-25830-2023 -22023:PHHC:077535 present petition for grant of regular bail and submits that apart from offences under Sections 323, 341, offence under Section 354-B, 354-C, 365 have also been made out. The sister of the injured has given a statement that she was forced to sit in the car. However, he does not dispute the above said facts. This Court has heard learned counsel for the parties and has perused the paper book.

Taking into consideration the overall circumstances and the conduct of the petitioner, this Court is not inclined to grant bail to the petitioner, at this stage.

Accordingly, the petition is dismissed.
