The substantive prayer made in the instant petition reads thus: "It is, therefore, respectfully prayed that this petition may kindly be allowed and the present petitioner may kindly be release on interim bail in case FIR No. 104 Dated 14.03.2025 u/s 190, 191(3), 115(2), 118(1), 103(1), 238 of Bhartiya Nyaya Sanhita, 2023 and sections 25, 27 of Arms Act, 1959 (erstwhile sections 149, 148, 323, 324, 302, 201 of IPC, 1860), Police Station Civil Lines, District Karnal by setting aside/modify the impugned order of the Ld. Court of Additional Sessions Judge, Karnal dated 17.04.2026 (Annexure P-1), the petitioner seeking interim bail for a duration of three weeks enable to attend Tervi and satarvi ceremony i.e. on dated 28.04.2026 and 02.05.2026 of his deceased mother, on terms and conditions as this Hon'ble High Court deem fit."

The relevant part of the impugned order dated 17.04.2026 (Annexure P-1) passed by the concerned trial Court reads thus: "7. The Superintendent, District Jail, Karnal is hereby directed to make necessary arrangements for security of accused under which he should be brought to attend the "Rasham Kirya" ceremony of his mother as referred to above on 26.04.2026 at 01.00 pm to 03.00 PM so that "Rasham Kirya" may be performed. CRM-M-21856-2026 -2lodged in the District Jail, Karnal after attending the "Rasham Kirya ceremony of his mother immediately without any delay. Vikas son of Sanjeev who is cousin of the accused Pardeep is directed not to supply any kind of food or any other eatable article which may deteriorate his health. The police officials on the duty at the time of visit of the accused while he will attend the "Kirya ceremony" of his mother shall also ensure that any kind of food or other article is not being given to the accused which may cause harm to his health and also to avoid any untoward incident. A copy of Lais order be transmitted to the SHO of Police Station concerned where the accused will attend the "Kirya" ceremony". Accordingly, the application stands disposed off being dismissed Compliance be made. Copy of this order be transmitted to Superintendent. District Jail, Karnal, immediately through Naib Court."

Having heard learned counsel for the rival parties and upon perusal of the record, this Court is not inclined to interfere with the above order dated 17.04.2026 passed by the trial Court, except to the extent that the petitioner shall be permitted to attend the Kirya ceremony of his mother from 12.00 PM to 4.00 PM, subject to other restrictions/conditions imposed by the trial Court. 4.
